1. Nature of the beta
The beta area is a private, pre-release testing environment for unfinished software (the "Beta"). It is provided solely for evaluation and feedback. It is not a consumer service, carries no service levels, and must not be relied upon for any purpose. By entering the password and confirming acceptance, you enter a binding agreement on the terms of this Beta Testing Policy (the "Policy"), which supplements the site Terms of Use.
2. Access
Access is limited to persons invited by the site operator and issued the access password. Access is personal, revocable, and non-transferable. You must not share the password, provide access to any other person, or attempt to access the Beta by any other means. We may revoke or suspend access at any time, with or without notice, for any reason or no reason.
3. Confidentiality
The Beta, including its features, appearance, and content, is confidential. You must not publicly disclose, publish, or share screenshots, recordings, or descriptions of unreleased features without our prior written consent. This obligation survives the end of your participation and ends only when the relevant material is made public by us.
4. Your conduct and submissions
You are solely responsible for all material you submit to the Beta. You must not submit material that:
- is unlawful under any applicable law;
- is sexually explicit or otherwise adult in nature;
- harasses, defames, or vilifies any person;
- infringes any intellectual property or other right of any person; or
- contains another person's personal information without their consent.
We may remove any material at any time without notice. You grant us a non-exclusive, royalty-free licence to host, display, and process material you submit, for the purpose of operating and developing the Beta.
5. No moderation
You acknowledge that the Beta is not actively moderated, that no moderation team exists at this stage, and that material submitted by other participants has not been reviewed by anyone before you see it. Concerns may be reported to admin@nswfurs.com and will be addressed as soon as reasonably practicable, without any guaranteed response time.
6. Availability and data
The Beta may be modified, interrupted, suspended, or discontinued at any time without notice. Any data you submit to the Beta, including test content and feedback, may be modified, deleted, or permanently destroyed at any time without notice and without any obligation to back up, preserve, or return it.
7. Feedback
You assign to us all right, title, and interest in feedback, suggestions, and ideas you provide in connection with the Beta, and we may use them for any purpose without restriction, attribution, or compensation. To the extent assignment is not effective, you grant us a perpetual, irrevocable, royalty-free licence to use them.
8. Assumption of risk
You participate in the Beta voluntarily and entirely at your own risk. You acknowledge that pre-release software contains defects, that content submitted by other participants is unreviewed, and that you may encounter errors, data loss, and objectionable material, and you accept those risks.
9. Disclaimer of warranties
The Beta is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, all conditions, warranties, guarantees, and representations of any kind, express or implied, are excluded, including as to availability, reliability, security, accuracy, and fitness for any purpose.
10. Limitation of liability
To the maximum extent permitted by law: (a) we are not liable for any loss or damage of any kind, whether direct, indirect, incidental, special, consequential, or exemplary, including loss of data, arising out of or in connection with the Beta, whether in contract, tort (including negligence), statute, or otherwise; and (b) our total aggregate liability arising out of or in connection with the Beta is limited to one hundred Australian dollars (AUD $100).
11. Australian Consumer Law
Nothing in this Policy excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted, or modified. To the extent liability under any such non-excludable provision can be limited, it is limited, at our option, to the resupply of the relevant service or the payment of the cost of resupply.
12. Indemnity
To the maximum extent permitted by law, you indemnify us and hold us harmless against all loss, damage, liability, cost, and expense (including reasonable legal costs) arising out of or in connection with your breach of this Policy, your unlawful conduct, or any material you submit to the Beta.
13. Termination and general
This Policy applies for as long as you access the Beta. Clauses 3 to 12 survive termination. If any provision is invalid or unenforceable it is severed and the remainder continues in force. This Policy is governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts. Questions go to admin@nswfurs.com.
